Clark County Las Vegas and cannabis – County Regulations and any new changes for dispensaries?

In November 2016, voters in Nevada approved the possession and sale of both medical and recreational marijuana. Consequently, adults 21 years and above can consume and smoke cannabis products. However, there are several regulations for the sale and distribution of marijuana products. These laws regulate Marijuana establishments such as dispensaries, production, testing, and cultivations facilities, and marijuana distributors. 

Where can a cannabis dispensary be located in Clark County? 

You cannot establish a marijuana dispensary within a thousand feet of a private or public school catering for students in grade pre-K all the way to grade 12. Your establishment can’t also be located within 300ft of a community or social facility. Moreover, any marijuana dispensary must be located in a separate building of a commercial facility or industrial zone and has to comply with Clark county land use, zoning, and signage ordinances.  

What document do you need to work in a Nevada medical marijuana dispensary? 

Every marijuana dispensary owner, employee, board member, contractor, or officer has to obtain a registration card from the Nevada Department of Taxation. The card is valid for a year and the application fee is $75. Required documents include:  

  • Clark County Business License Application Form: To register a marijuana establishment, you need to fill and file a Clark County Business License Application Form. This document is necessary for any privileged business to operate in Clark County.  
  • Privileged & Regulated Financial Questionnaire: This document also needs to be completed. On it, you are going to provide information about your business, employees, source of funds, ownership, partnerships and any other information as required by Clark County.  
  • Marijuana Establishment Ownership Disclosure Form: This form is used to provide information about the owners of the business and anyone with an ownership interest in the dispensary. This includes partners and contractors.  
  • Change of Location for Marijuana Establishments: When changing the location of a marijuana establishment, the owner needs to inform the Clark County authorities and fill a change of location form to ensure the compliance of zoning and restriction laws. Transferring the business to someone else also requires you to fill a transfer of ownership form.  

Laws regarding cannabis advertising and promotion in Clark County Nevada  

Dispensaries in Clark County Nevada are required to abide by a set of rules when it comes to advertising and promoting their products. Dispensaries are forbidden to:  

  • Engage in misleading, or false advertising illustrations of statements 
  • Encourage over consumption of cannabis products 
  • Depict real consumption of cannabis by people under 21 years 
  • Portray anything that suggests the presence of a child. This includes toys, mascots, cartoon characters, balloons, action figures, or any other object that might be appealing to anyone under the age of 21 years. 
  • Advertise in publications, television, radio, and other communication channels where 30% of the users are below 21 years. 
  • Sponsor youth entertainment and sport events 
  • Place adverts inside public facilities or transportation utilities   
  •  Offer or advertise cannabis as “donated” or “free” without making a purchase. 
  • All adverts should have conspicuous “For use only by adults 21 years of age and older” and “Keep out of reach of children” warnings. 

Before selling cannabis products to a consumer, dispensaries in Clark county need to:  

  • Verify that the consumer is 21 years or above by checking their government ID using a scanner to ensure its validity. 
  • Provide appropriate educational and support materials 
  • Specify the amount sold, and the date of sale.
